TERMS OF SERVICE
THE KINGS AND QUEENS MEDICAL COLLEGE TERMS AND CONDITIONS
The Kings & Queens Medical University College Terms and Conditions of service apply to all academic enrichment programs operated by The Kings & Queens Medical University College. “Parent(s)/guardian(s)” are defined as those charged with legal responsibility for the child or children, person or persons that he/she/they (the parent(s)/guardian(s) have enrolled at The Kings & Queens Medical University College. Said “students, person or persons” enrolled at The Kings & Queens Medical University College are referred to as “participant/attendee” herein.
1. Release from Liability
The participant/attendee has permission to participate in all class activities led by The Kings & Queens Medical University College staff and its visiting science or engineering specialist or volunteers. In the highly unlikely event of an emergency, the parent(s)/guardian(s) of participant/attendee gives The Kings & Queens Medical University College permission to seek emergency medical treatment, including ordering of diagnostics tests (e.g., MRIs, x-rays or blood draws, etc), if deemed necessary and/or advisable by a healthcare professional. Additionally, the parent(s)/guardian(s) gives permission to the healthcare professional (e.g., EMS worker, nurse, physician, etc.) responding to any health/medical emergency to secure and administer emergency medical or surgical treatment and/or hospitalization, if necessary. In these cases, The Kings & Queens Medical University College will make every effort to contact the parent(s)/guardian(s) immediately and notify them regarding any required care; however, care will not be denied or delayed for lack of parental/guardian contact or consent, as this release provides that.
I HEREBY WAIVE AND RELEASE THE KINGS AND QUEENS MEDICAL UNIVERSITY COLLEGE, ITS OWNERS, AGENTS, PARTNERS, FACILITY PROVIDERS, AND EMPLOYEES FROM LIABILITY FOR ANY INJURY OR ILLNESS INCURRED WHILE AT THE KINGS AND QUEENS MEDICAL UNIVERSITY COLLEGE, RESULTING FROM ORDINARY NEGLIGENCE (I.E., AN ACCIDENT). I AGREE THAT THERE IS MINIMAL RISK OF INJURY TO THE PARTICIPANT AS A RESULT OF THE KINGS AND QUEENS MEDICAL UNIVERSITY COLLEGE ACTIVITIES, AND KNOWINGLY AND VOLUNTARILY ASSUME ALL RISK OF SUCH INJURY. HOWEVER, I AGREE THAT I AM NOT RELEASING THE KINGS AND QUEENS MEDICAL UNIVERSITY COLLEGE, ITS OWNERS, AGENTS, PARTNERS, FACILITY PROVIDERS, AND EMPLOYEES FROM GROSS NEGLIGENCE OR RECKLESS CONDUCT. TO THE EXTENT THIS RELEASE CONFLICTS WITH GHANA LAW GOVERNING RELEASES, THIS RELEASE IS TO BE GIVEN THE FULLEST FORCE AND EFFECT PERMITTED UNDER STATE LAW. IF THIS RELEASE OR ASPECTS THEREIN ARE DETERMINED TO BE INVALID UNDER THE LAWS OF GHANA, THEN THIS RELEASE SHALL BE STRICKEN FROM THIS CONTRACT, BUT ALL OTHER TERMS AND CONDITIONS OF THIS AGREEMENT SHALL REMAIN IN EFFECT.
2. Enrollment Information
By authorizing the participant/attendee to attend The Kings & Queens Medical University College, the parent(s)/guardian(s) must agree to all Terms and Conditions. By completing the registration and enrollment process, the parent/guardian provides voluntary and knowing agreement to the contents of the Kings & Queens Medical University College's Terms and Conditions.
All information about the participant/attendee that The Kings & Queens Medical University College collects is considered confidential and used to aid its staff, visiting science and engineering specialists or volunteers in assessing crucial information regarding health and wellness and facilitating the best possible learning experience for the participant/attendee.
Participant/attendee is officially enrolled at The Kings & Queens Medical University College only after a written or electronic (i.e., email) enrollment confirmation is sent from The Kings & Queens Medical University College.
2a. Providing Enrollment Information
Upon enrollment, The Kings & Queens Medical University College requires completion of a Health and Wellness Form, a Student Profile Form, Equipment, Supplies and Facilities Respect Use Form, and a Pick-Up and Drop-Off Form. These forms both request and convey information and policy regarding The Kings & Queens Medical University College and expectations of parent(s)/guardian(s) and their participant(s)/attendee(s). This includes information about the participant/attendee including but not limited to date of birth, gender, allergies, best participant/attendee transition approaches, etc.
The Kings & Queens Medical University College requires the completion of such forms for informational and/or precautionary purposes in order to help its staff, visiting science and engineering specialists or volunteers ensure the health and well-being of and best learning experience for each and all participant(s)/attendee(s) collectively. The Kings & Queens Medical University College requires the completion of forms relating policy to create clarity about the rules, guidelines, policies, etc., of Kings & Queens Medical University College. These rules, guidelines, policies, etc. are for the health, safety, well-being and harmonious function of The Kings & Queens Medical University College and its environs.
All forms are to be completed by the participant/attendee's parent(s)/guardian(s) only and submitted ten business days (two weeks) prior to the start of classes.
These four forms are referred to and explained within the Terms and Conditions.
The Health and Wellness Form includes requests for the:
Primary Contact Person in case of emergency along with a Secondary Contact Person and information concerning these parties—such as name of contacts, phone numbers, email, and address.
Participants/attendee’s primary care physician’s name and contact information.
Participant/attendee’s proof of immunization from his/her physician.
Medical insurance carrier and the policy number of the participant/attendee. If the participant/attendee is not covered under a health insurance plan, or if parent(s)/guardian(s) do not wish to provide The Kings & Queens Medical University College with medical insurance information, the parent(s)/guardian(s) agree(s) to accept all financial liability in the highly unlikely event that the participant/attendee should become injured while attending The Kings & Queens Medical University College. Parent/guardian(s) release and indemnify The Kings & Queens Medical University College from any and all financial responsibilities.
Full disclosure of the participant/attendee’s specific limitations to participate in any Kings & Queens Medical University College activities, i.e., meditation/basic yoga, science or engineering labs or classroom learning. If no restriction information is provided, the parent(s)/guardian(s) thereby certifies that the participant/attendee is in good physical and mental health and able to participate in all of The Kings & Queens Medical University College’s activities. The parent(s)/guardian(s) agrees to identify any medical condition or history (including psychiatric, neuropsychological or learning related) that would require special attention by The Kings & Queens Medical University College upon enrollment.
Parent/ Guardian to inform in writing The Kings & Queens Medical University College of any known allergies, e.g., seasonal; food-related, e.g., gluten, grains, e.g., popcorn; materials-related, e.g., latex and adverse drug reactions and if so, whether the participant/attendee will have an EpiPen, inhaler or other prescribed medication to be identified on the Health and Wellness Form.
The parent(s)/guardian(s) certifies that he/she/they know of no restrictions, cognitive, emotional or physical impairments, or any other factors, which in any manner may limit the participant/attendee’s participation in such a program.
In the highly unlikely event of an emergency requiring medical attention, the parent(s)/guardian(s) gives permission to The Kings & Queens Medical University College to arrange necessary related emergency transportation for the participant. Parent/guardian agrees to release any medical or personal records necessary for insurance purposes. The Kings & Queens Medical University College will make every attempt to contact the parent(s)/guardian(s) or the emergency contact(s) listed on the participant/attendees account before taking this action. Parents and guardians acknowledge that they are responsible for medical expenses due to the participant/attendee’s illness or injury.
The parent(s)/guardian(s) authorizes the Kings & Queens Medical University College staff, visiting science or engineering specialists or volunteers to attend to minor medical issues or injuries the participant/attendee may incur while at The Kings & Queens Medical University College (e.g., placing a band aid on a paper cut, providing an icepack for a minor bruise), etc.
The Kings & Queens Medical University College does not directly or indirectly administer medication. It has a policy of not “administering medicine” but seeks to be informed of any medicines taken during class time for informational purposes only. It is the responsibility of parent(s)/guardian(s) to develop appropriate medicine administration protocols with his or her child.

3. Lost, Stolen, or Damaged Property
3a. Lost, Stolen or Damaged Property Belonging to Participant/Attendee
The Kings & Queens Medical University College maintains a “lost and found” bin for all items identified and not claimed after class times. Please check in the administration office if the participant/attendee has lost something. At the end of each trimester, lost and found items will be donated to Cradles or other appropriate charitable organizations.
The Kings & Queens Medical University College encourages parent(s)/guardian(s) to label clearly all participant/attendee’s property with first and last name. The Kings & Queens Medical University College will make every effort to return said property if found by staff, visiting science or engineering specialists, volunteers or another participant/attendee.
Participant/attendee is responsible for his/her personal property while at The Kings & Queens Medical University College
The Kings & Queens Medical University College cannot be held responsible for any personal belongings lost or damaged by casualty or theft, etc.
If any loss or theft of, or damage to participant/attendee’s property should occur at The Kings & Queens Medical University College or programs, parent(s)/guardian(s) agrees that The Kings & Queens Medical University College cannot and will not be held liable.
3b. Lost, Stolen or Damaged Kings & Queens Medical University College Property
To provide excellence in science and engineering learning, The Kings & Queens Medical University College uses high quality equipment and supplies (e.g., stereoscopes, compound microscopes, etc.) to expose participant/attendees to what it is like to be a real scientist and engineer. The Kings & Queens Medical University College asks parent(s)/guardian(s) to review and cosign with the enrolled participant/attendee its Equipment, Supplies and Facilities Respect Use Form. Participants/Attendees will also find clearly marked instructions and guidelines for equipment and supplies usage at The Kings & Queens Medical University College. These procedures and protocol will also be reviewed the first two class sessions.
To provide excellence in science and engineering learning, The Kings & Queens Medical University College thoughtfully and selectively employs highly quality electronic and computer equipment (e.g., monitors/televisions; computer tablets, pads, laptops, etc.) to enhance the learning experience of participant/attendees.
Participant/attendee is responsible for property damage that they cause while at The Kings & Queens Medical University College.
Recklessness, gross negligence, intentional damage and/or destruction of The Kings & Queens Medical University College’s equipment, supplies or facilities constitutes grounds for immediate dismissal from The Kings & Queens Medical University College without any refund.
Parent/guardian agree to accept full responsibility, financially or otherwise, for the conduct of participant/attendee—including damage to and/or destruction of equipment, supplies and/or facilities while at The Kings & Queens Medical University College. This does not include ordinary negligence (i.e., accidents).
ON BEHALF OF THE PARTICIPANT/ATTENDEE, THE PARENT(S)/GUARDIAN(S) HEREBY RELEASES THE KINGS AND QUEENS MEDICAL UNIVERSITY COLLEGE AND ITS OWNERS, AGENTS, PARTNERS, FACILITY PROVIDERS AND EMPLOYEES FROM LIABILITY (INCLUDING CLAIMS BASED UPON NEGLIGENCE) FOR DAMAGE TO OR THEFT OF THE PARTICIPANT/ATTENDEE’S PERSONAL PROPERTY. THE PARENT(S)/GUARDIAN(S) TAKES THE FULL RESPONSIBILITY FOR ANY AND ALL SUCH DAMAGE. THE PARENT(S)/GUARDIAN(S) ALSO ASSUMES FULLY RESPONSIBILITY FOR THE REPLACEMENT VALUE OR REPAIR OF EQUIPMENT, SUPPLIES OR PROPERTY OF THE KINGS AND QUEENS MEDICAL UNIVERSITY COLLEGE BY THE PARTICIPANT/ATTENDEE UNLESS THE RESULT OF ORDINARY NEGLIGENCE (I.E. ACCIDENTS).
THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION, WHICH MAY BE ENFORCED BY BOTH PARTIES.
ARBITRATION IN LIEU OF LITIGATION: Parent(s)/guardian(s) agree that any dispute arising out of or relating to this Agreement, parent(s)/guardian(s) participant/attendee’s participation at The Kings & Queens Medical University College or otherwise arising between the parties, including, without limitation, any participants statutorily created or protected rights, as permitted by applicable laws of Ghana, shall be settled by arbitration in Ghana, in accordance with the Commercial Rules of the Ghana Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court of competent jurisdiction. The prevailing party in the arbitration shall be entitled to recover expenses including costs and reasonable attorney’s fees associated therewith. Should any part of this contract be found invalid or not enforceable by a court of law, then the remaining portion shall continue to be valid and in force. Parent(s)/guardian(s) hereby acknowledge that parent(s)/guardian(s) agree to and will comply with the terms and provisions of the ARBITRATION AGREEMENT.

4. Participant/Attendee Code of Conduct
The Kings & Queens Medical University College has the right to dismiss any participant/attendee if his/her actions or attitudes are deemed inconsistent with, detrimental to, or undermining of the general atmosphere of The Kings & Queens Medical University College and that there shall be no refunds issued for such dismissal, as set forth below in The Kings & Queens Medical University College Participant/Attendee Code of Conduct.
Parent(s)/guardian(s) agree to review and ensure understanding of The Kings & Queens Medical University College Code of Conduct with the parent’s(s’)/guardian’s(s’) participant(s)/attendee(s) participating in a program run by The Kings & Queens Medical University College.
Parent(s)/guardian(s) of a participant/attendee attending The Kings & Queens Medical University College program agree that participant/attendee must act in a way consistent with The Kings & Queens Medical University College’s Code of Conduct.
Parent(s)/guardian(s) agree that parent’s(s’)/guardian’s(s’) participant(s)/attendee(s) can be dismissed from classes if his/her behavior, language, actions or attitudes are deemed inconsistent with, detrimental to, or undermining of the general atmosphere to the atmosphere or to other participants at The Kings & Queens Medical University College.
Parent(s)/guardian(s) agree that parent(s)/guardian’s(s’) participant(s)/attendee(s) can be dismissed, without a refund from The Kings & Queens Medical University College for the following reasons: viewing pornography or any inappropriate material on the Internet; inappropriate language (swearing, using bad words, racial, ethnic, religious or homosexual slurs); physical violence or threats of physical violence against other participants or The Kings & Queens Medical University College staff, visiting science or engineering specialists, or volunteers; damage to or destruction of The Kings & Queens Medical University College facilities or The Kings & Queens Medical University College’s equipment, stealing property of others; Inappropriate use of equipment; sexual harassment of other participants or The Kings & Queens Medical University College staff, visiting science or engineering specialists, volunteers; Internet hacking; or bullying.
Participant/attendee promises to demonstrate respect for him/herself, all of The Kings & Queens Medical University College’s staff members, visiting science or engineering specialists, volunteers; other participants/attendees; and clients, lessees at Global Church Street, Kpong, Ghana and physical neighbors of The Kings & Queens Medical University College while treating the facilities and equipment with care.
The parent(s)/guardian(s) and participant/attendee understand that The Kings & Queens Medical University College has a “no tolerance” policy regarding bullying. Bullying is cause for immediate dismissal without advanced warning and with no refund of tuition, registration, materials fees or ANY other fees.

5. Electronic Devices Used During the Course of the Program
5a. Personal Electronic/Computer Devices
The Kings & Queens Medical University College does not require participant/attendees to bring personal electronic computing or communication devises or equipment to The Kings & Queens Medical University College. The Kings & Queens Medical University College does understand that parent(s)/guardian(s) would like to be able to communicate with participant/attendee. Should the participant/attendee bring a personal electronic/computing/communications device to the program, please note:
Personal electronic devices may NOT be used during instructional times, unless the Instructor approves them.
Cell phones/smart phones can be kept on hand but MUST BE in silent mode during attendance at The Kings & Queens Medical University College
Accessing the Internet via a local Wi-Fi hotspot at The Kings & Queens Medical University College is the sole responsibility of the participant/attendee and his/her/their parent(s)/guardian(s). Participant/attendee and parent(s)/guardian(s) must comply with all Kings & Queens Medical University College terms & conditions, and assume all financial risk. The Kings & Queens Medical University College does not facilitate Internet access for non- Kings & Queens Medical University College devices.
Viewing inappropriate content (including sexual content, inappropriate violence, racism, bullying, etc.) online will result in immediate dismissal from The Kings & Queens Medical University College, without a refund.
Any attempts at computer “hacking” will result in immediate dismissal from The Kings & Queens Medical University College, without a refund.
Participant/attendee have defined and limited access to computers and equipment for their classes while at The Kings & Queens Medical University College, under instructor supervision. Feel free to leave personal electronic devices at home. Certain filtering software is placed on Kings & Queens Medical University College computers to protect The Kings & Queens Medical University College Innovation Institute’s participants/attendees, and this may not be the case with a personal device.

6. Student Drop-off and Pick-up
The Kings & Queens Medical University College is located at L30/1, Global Church Street, Kpong, P. O Box 18, New Akrade, Akosombo, E/R, Ghana (mailing address).
Parent(s)/guardian(s) and those persons authorized by the parent(s)/guardian(s) must drop of and pick up participant/attendee from The Kings & Queens Medical University College WITHIN suite 300 only. Participants/attendees should never be left outside the building or in the building's lobby unaccompanied by an adult authorized by the parent(s)/guardian(s). Participants/attendees must always be accompanied by parent/guardian or authorized adult for pick-up and drop off, unless specific written arrangement have been made in advance with The Kings & Queens Medical University College. This is for the safety and security of participant/attendees. Those picking up the participant/attendee must have valid picture identification (Driver’s License or Passport) and their names must be on file with The Kings & Queens Medical University College staff.
For the safety and security of The Kings & Queens Medical University College participant/attendees, The Kings & Queens Medical University College staff, guest science or engineering specialists or volunteers will NOT release a participant/attendee to an unauthorized person.
Parent/guardian must notify The Kings & Queens Medical University College in advance using The Kings & Queens Medical University College Change of Dismissal Form authorizing The Kings & Queens Medical University College staff to release his/her participant/attendee to another person who he/she/they authorize. That person must be carrying picture identification (i.e., Driver’s License or Passport).
Parent(s)/guardian(s) agree to abide by all STOPPING, LOITERING, PARKING rules, regulations, laws, common courtesies, signs and placards of The Kings & Queens Medical University College, City of Akosombo, Village of Kpong and private property owner’s (if on his/her/their private property) when picking up and dropping off students at The Kings & Queens Medical University College. Failure to abide by these rules, all regulations, policies, signs and placards are grounds for immediate dismissal of the parent’s(s’)/guardian’s (s’) participant(s)/attendee(s) without any refund.
The Kings & Queens Medical University College is not responsible or liable for any parking fine violations or infractions incurred by the parent(s)/guardian(s) when picking up or dropping off his/her/their participants/attendees at The Kings & Queens Medical University College
Parent(s)/guardian(s) agree to find a legal on- or off-street parking space if they intend to escort his/her/their participant/attendee to The Kings & Queens Medical University College entrance, suite 300, at Global Church Street, Kpong. As part of enrollment, parent(s)/guardians(s) will be asked to sign The Kings & Queens Medical University College Pick-Up and Drop-Off Policy Form.
